General Terms and Conditions

§ 1 Scope of application, customer information

The following general terms and conditions (GTC) govern the contractual relationship between seeITnow GmbH (ATEXshop) and companies that purchase goods from our shop. We do not recognize any terms and conditions that conflict with or deviate from our terms and conditions. The contract language is German.


§ 2 Conclusion of contract

(1) The offers on the internet represent a non-binding invitation to you to purchase goods.

(2) You can place one or more products in the shopping cart. During the ordering process, you enter your data and requests regarding the method of payment, delivery terms, etc. Only by clicking the order button do you submit a binding offer to conclude a purchase contract. You can also place a binding order by fax. The confirmation of receipt of the order, which is sent immediately by e-mail or fax, does not yet constitute acceptance of your purchase offer.

(3) We are entitled to accept your offer within 2 working days by sending you an order confirmation by e-mail or fax. If the period specified in sentence 1 expires without result, your offer shall be deemed rejected, i.e. you are no longer bound by your offer.


§ 3 Customer information: Storage of the contract text: We store your order with details of the contract concluded (e.g. type of product, price, etc.). However, you cannot access your past orders via the internet. We will send you the terms and conditions, but you can also access them at any time via our website. If you wish to save the product description on our shop page for your own purposes, you can, for example, take a screenshot (screen shot) or print the entire page at the time of ordering.


§ 4 Customer Information: Correction Notice You can correct your entries at any time before placing the order by using the backspace key. We will inform you about further correction options as you proceed through the ordering process. You can also end the ordering process at any time by closing the browser window.


§ 5 Retention of Title The purchased item remains our property until full payment has been received.


§ 6 Legal rights of liability for defects and limitation (1) Legal rights of liability for defects: Legal rights of liability for defects exist for our goods. (2) Limitation of liability for defects (guarantee): Your guarantee claims for defects in the purchased goods become time-barred one year after the transfer of risk. The following claims are excluded from this regulation: - for compensation - due to fraudulently concealed defects - from a possibly given guarantee - for recourse according to §§445a, 478 BGB - due to defects in building materials and components that have been used for a building in accordance with their usual purpose and have caused its defectiveness. The statutory limitation periods apply to these excluded claims. In the event of a possibly given guarantee period, the longer period shall apply in favor of the buyer.


§ 7 Limitation of Liability We exclude liability for slightly negligent breaches of duty, provided that these do not relate to essential contractual obligations, damages resulting from injury to life, limb or health, guarantees or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our agents and our legal representatives. The essential contractual obligations include, in particular, the obligation to hand over the goods to you and to procure ownership of them for you. Furthermore, we must procure the goods for you free of material defects and defects of title.


§ 8 Place of Jurisdiction

The exclusive place of jurisdiction for all disputes arising from this contract is our place of business if you are a merchant.
